Terms of Service

By accessing or using Constructeams, you agree to these Terms of Service. If you do not agree, do not use the service. Use of the services is also governed by our Privacy Policy.

Constructeams provides software tools to help construction teams plan, coordinate, and manage project operations, including projects, tasks, notes, contacts, photos, documents, daily reports, calendar events, meetings, feed posts, Time Clock, bid board workflows, mobile workflows, AI features, and related tools.

You may use the services only for lawful business purposes and in accordance with these Terms. Constructeams does not provide legal, engineering, architectural, safety, financial, tax, payroll, or professional advice.

You must be old enough to enter into a binding agreement and use Constructeams on behalf of yourself or an organization you are authorized to represent. The services are intended for business use and are not directed to children or personal household use.

You are responsible for maintaining the confidentiality of your account credentials, verification codes, devices, and sessions, and for all activity that occurs under your account. You must provide accurate account information and promptly update it when needed.

If you create, administer, or manage an organization or workspace, you are responsible for your workspace settings, invited users, roles, permissions, plan selections, billing choices, and content submitted by users you invite or authorize. Invited users and team members must follow these Terms, and workspace owners or administrators may control or remove their access.

By providing your phone number and using Constructeams, you consent to receive SMS messages from Constructeams related to account authentication, account access, verification, and login security (such as 2FA). These messages are transactional and are only sent in response to user-initiated actions such as logging in, requesting a verification code, or verifying your account.

Message frequency varies based on your activity. Message and data rates may apply.

You can opt out of receiving SMS messages at any time by replying STOP. For assistance, reply HELP.

Constructeams does not send marketing or promotional messages via SMS. We do not sell, rent, trade, or share personal information, including phone numbers or SMS consent, with third parties or affiliates for marketing or promotional purposes.

You may not misuse the services, including by:

• Attempting unauthorized access to systems or data.
• Interfering with platform performance or security.
• Uploading malicious code or harmful content.
• Using the services in violation of applicable law.
• Submitting false, misleading, infringing, unlawful, confidential, or unauthorized content.
• Using the services to harass, threaten, impersonate, spam, scrape, overload, reverse engineer, or abuse Constructeams, other users, or third-party systems.
• Bypassing plan limits, rate limits, storage limits, seat limits, AI credit limits, fair-use controls, or security controls.

You retain ownership of content you submit, upload, create, or import into Constructeams, including project data, tasks, notes, contacts, project photos, documents, daily reports, calendar events, meetings, feed posts, comments, bid board postings, uploaded files, images, captions, and related materials.

You grant Constructeams a limited, non-exclusive, worldwide license to host, store, copy, process, transmit, display, format, index, analyze, and otherwise use your content as needed to provide, secure, support, and improve the services; operate backups and audit logs; process uploads; sync mobile and offline workflows; provide AI features you request; and comply with law.

You are responsible for having the rights and permissions needed to submit content to Constructeams and to share it with your organization, invited users, external recipients, or third-party services.

Constructeams may allow users to browse opportunities, create bid board posts, attach documents, save searches, receive alerts, manage responses, and view analytics. You are responsible for bid postings, responses, documents, contact information, and other content you submit.

Some bid opportunities, documents, or links may come from external public sources or third-party websites. Constructeams does not guarantee that external bid information is complete, current, accurate, available, or suitable for your use. You should verify bid details, deadlines, requirements, and source terms directly with the official source before relying on them.

Constructeams may provide AI features that process prompts, project context, documents, photos, daily reports, calendar data, bid board information, and other content you choose or that is available in your workspace. AI features may be limited by plan, usage controls, document page caps, attachment limits, or AI credit balances.

AI outputs may be incomplete, inaccurate, outdated, or unsuitable for your situation. You are responsible for reviewing AI outputs before relying on them. AI features do not provide legal, engineering, architectural, safety, financial, tax, payroll, or professional advice.

AI credits, included credit amounts, boost credits, credit costs, expiration rules, eligible AI actions, and feature availability may change over time. We may apply limits, suspensions, or additional review to prevent abuse, excessive usage, or unsafe use.

Constructeams and its underlying software, design, and branding are the property of Constructeams and protected by intellectual property laws. Except for rights expressly granted in these Terms, no other rights are transferred to you.

Constructeams may offer free plans, paid subscription plans, launch pricing, promotions, storage add-ons, seat add-ons, AI credit purchases, and other paid features. Paid plans, if selected, are billed according to your subscription terms and the checkout or billing flow presented at purchase.

You are responsible for applicable fees, taxes, payment obligations, billing details, plan selections, seat usage, storage usage, add-ons, and purchases associated with your account or organization. Payment processing may be handled by Stripe or another payment provider, and their terms may apply.

Unless otherwise stated, subscriptions renew automatically until canceled. You may cancel or change plans through available account or billing tools, but cancellation timing, downgrade timing, and access changes may depend on the plan, billing cycle, and payment provider flow. Fees are generally non-refundable except where required by law or stated in a separate written agreement.

If payment fails, is disputed, or is not received on time, we may suspend, limit, downgrade, or terminate paid features, add-ons, AI credit access, storage expansion, or account access after reasonable notice where required by law.

Pricing, plans, features, limits, add-ons, storage amounts, seat limits, AI credit amounts, AI credit costs, and promotional offers may change from time to time. For paid subscriptions, we will provide notice before material paid-plan pricing changes take effect. Unless otherwise stated, pricing or plan changes for an active paid subscription apply at renewal or the next billing cycle. Free plans, launch pricing, promotions, included credits, and feature availability may be changed, limited, or discontinued prospectively.

References to free, included, unlimited, or launch-price features are subject to these Terms, applicable plan limits, technical limits, fair-use controls, abuse prevention, storage and seat limits, AI credit limits, and future plan changes.

Constructeams depends on third-party services for hosting, databases, authentication, file storage, analytics, diagnostics, billing, email, SMS, push notifications, AI processing, app distribution, maps or location workflows, and external bid source links. These services may include providers such as Supabase, Stripe, storage providers, hosting providers, app stores, communications providers, analytics providers, AI service providers, and external bid sources.

Third-party services, websites, app stores, payment processors, and external bid sources are governed by their own terms and privacy policies. Constructeams is not responsible for third-party services that it does not control.

If you download or use a Constructeams mobile app through Apple, Google, Expo, or another app-store or distribution platform, the platform's terms, rules, review requirements, and payment or distribution policies may also apply.

Mobile functionality may depend on device permissions, operating system settings, network availability, camera access, photo library access, notification permissions, location permissions, and app-store platform services.

We work to provide reliable access to the services, but availability may vary and may be interrupted for maintenance, upgrades, or events outside our control.

We may maintain backups, logs, and recovery processes, but Constructeams is not a guaranteed backup or archival service. You are responsible for maintaining copies of important business records, contracts, bid materials, payroll records, project documents, photos, and reports as appropriate for your business.

To the maximum extent permitted by law, Constructeams is not responsible for loss, corruption, deletion, unavailability, or failure to store any content, data, or records except as expressly required by applicable law or a separate written agreement.

The services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Constructeams disclaims implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Constructeams does not guarantee uptime, uninterrupted access, error-free operation, payroll compliance, bid accuracy, government bid validity, professional outcomes, AI output accuracy, or that any feature will meet your specific business, legal, safety, payroll, accounting, or compliance needs.

To the maximum extent permitted by law, Constructeams will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, revenue, goodwill, business opportunities, bid opportunities, payroll records, project records, or business interruption, arising from or related to your use of the services.

To the maximum extent permitted by law, Constructeams' total liability for claims arising from or related to the services will not exceed the amounts you paid to Constructeams for the services giving rise to the claim during the three months before the event giving rise to liability, or one hundred dollars if you used only free services.

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Constructeams from claims, losses, liabilities, damages, costs, and expenses arising from your content, your use of the services, your violation of these Terms, your violation of law, or your infringement or misuse of another party's rights.

You may stop using the services at any time. We may suspend, limit, downgrade, or terminate access if these Terms are violated, if payment is past due, if use creates security or operational risk, if content or activity appears unlawful or abusive, if required by law, or if needed to protect users, third parties, or the platform.

After termination or cancellation, access to paid features, add-ons, AI credits, storage expansion, workspace content, or account data may be limited or discontinued, subject to applicable law, backup retention, and any separate written agreement.

We may update these Terms from time to time. When updates are made, the revised Terms will be posted at https://constructeams.com/terms with an updated effective date. Continued use of Constructeams after updated Terms become effective constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Tennessee.
